Stormwater Off Right-of-Way Assistance Program (Abridged)


Implemented: 2002

Purpose: To provide property owners with an open channel (non-piped) solution to erosion or flooding problems associated with stormwater runoff.

Program Qualifications:

  • The problem must involve some portion of water from a City maintained street.
  • The impact of the stormwater runoff must be that a reasonable engineering solution will at a minimum reduce damage or financial loss.

Program Benefits:

  • The City will bear the cost of the construction of an approved design that will manage the flow of stormwater and address the accepted need, up to the amount indicated in the spending limit policy.
  • These open channel (non-piped) designs will be built to meet City design standards.
  • A permanent drainage & utility easement is not required on the part of the property owner. The City will require only a temporary construction easement for access during construction time.

Program Restrictions:

  • In recognition of the overall community benefit that open channels provide, the Off Right-of-Way Assistance Program is committed to providing a non-pipe solution.
  • This will be a one-time improvement by the City. This improvement will not become part of the City’s Stormwater System. Maintenance of the improvement will be the responsibility of the property owner.
  • Requests for service will be prioritized, through the Citizens Advisory Panel, based on date received and threat to the property.

Storm Drain Extension Policy (Abridged)


Implemented: 1970

Amended: 2003

Purpose: To provide property owners with a solution to erosion or flooding problems associated with increased stormwater runoff allowing for both piped and non-piped solutions.

Policy Requirements:

  • Property owner will be financially responsible for the cost of the materials. The City will provide the equipment and labor for the installation of the materials up to a 36” reinforced concrete pipe.
  • Property owner will grant a permanent drainage & utility easement, at no cost to the City, where pipe improvements will be made. Non-pipe solutions will be require a temporary construction easement for access during construction.
  • There is a $100.00 non-refundable application fee. This fee will be applied to the final estimated cost of the materials.

Policy Benefits:

  • Policy allows for EITHER a piped or a non-piped solution for a problem.
  • Piped solutions can be built to City specifications and become part of the City’s storm drainage system. This means that the City will be responsible for the maintenance of that system.
  • Since the private property owner is financially invested in the project, every attempt is made to complete the work as soon as assets become available.

**** In keeping with Section I-(c) of the City Storm Drain Extension Policy, the City does NOT maintain open channels outside of the street right-of-way. Regardless of which program is utilized for installation; all open channels and creeks are the responsibility of the private property owner.
