Procedures for Purchasing City-Owned Property
If you have an interest in acquiring property
owned by the City of Gastonia, you should:
- Obtain a tax map for the property you
are interest in purchasing.
- Bring the tax map to the Real Estate
Division, Room 222, of the Garland Municipal Business Center and discuss your interest
in acquiring the property.
- The Real Estate Division will notify
all City departments of your interest in acquiring the
property. Each department will notify the Real Estate
Division if they have any objections to the property being
sold. This process takes about three (3) weeks.
- You will be notified of the response
by the departments. If you desire to proceed, an appraiser
who is approved by the City must appraise the property.
The cost of the appraisal and the cost of a survey will
be added to the purchase price at the closing on the property.
- You must submit two (2) original copies
of the attached form as your written offer. A deposit
of five percent (5%) of your offer amount must accompany
the offer. The deposit must be in certified funds. Please
be sure you have your signature NOTARIZED on the offer.

- Your written offer and appraisal will
be presented to the City Council's Facilities Committee
for preliminary approval or rejection before being presented
to the full City Council.
- If the City Council approves of selling
the property, a resolution detailing your offer and the
Council's intent to accept your offer, subject to receipt
of a qualified upset bid will be adopted. The upset bid
period is ten (10) days.
- The resolution will be advertised one
time for upset bids pursuant to state law. You will pay
the cost of all advertising, if you are the successful
purchaser of the property. This will be added to the cost
of the property at the closing.
- In the event of an upset bid, it will
be advertised again for upset bids and you will be given
an opportunity to bid again.
- If there are no upset bids within the
ten (10) day period, the property will be deeded to you
upon payment of the balance of the purchase price and
all additional expenses as outlined above. The deed will
be a Special Warranty Deed.
- The City of Gastonia reserves the right
to accept or reject any or all bids or offers.
Process after Bid is Received
- Offer/bid must be presented to the Council's
Facilities Committee. (This usually takes about two (2)
weeks.
- Offer/bid is then presented to the next
City Council meeting following the meeting of the Facilities
Committee with the recommendation of the Committee. (This
can take up to two (2) additional weeks.
- If offer/bid is approved by the City
Council, a legal ad will appear in the Gaston Gazette
on the following Sunday with the information concerning
the Ten-day Upset Bid process.
- If no upset bids are received by 5 PM
on the 10th day after the legal ad appears in the paper,
the sale is finalized as soon as the necessary legal papers
can be drawn up. If there is a legal upset bid, that new
bid is advertised following the same procedure as shown
above.
NOTE: To qualify as a legal upset
bid, it must be received before 5 PM on the 10th day after
the legal ad appears in the paper. The bid must exceed the
prior bid by a minimum of 10 percent (10%) of the first
$1,000 and 5 percent (5%) of the balance. A deposit of the
new bid amount must accompany the bid.
